参加同意・リスクの確認
および免責事項

1. 対象となる活動

この同意書は、Vitalwit LLCが提供する対面・オンラインのレッスンおよびプログラムに適用されます。活動には、参加者自身が行う骨盤まわりのセルフエクササイズ、ストレッチ、ボディトーニング、顔・首まわりのセルフケア、およびこれらに付随する一般的な健康・栄養情報の提供が含まれます。講師による施術や手技は含まれません。

2. 医療行為ではないこと

レッスンおよび健康・栄養に関する情報提供は、医療上の診断、治療、リハビリテーション、個別の医療・栄養療法を目的とするものではありません。特定の症状の改善や効果は保証されません。

3. 健康状態と参加の判断

私は、自分の健康状態や体力に応じて参加を判断します。妊娠中・産後、治療中、手術後、けがや持病がある場合など、運動の可否に不安があるときは、必要に応じて医療専門職に確認します。安全な指導に関係する制限や注意事項は、参加前に講師へ伝えます。

痛み、めまい、息苦しさなどの異常を感じた場合は、直ちに運動を中止し、必要に応じて医療機関を受診します。

4. リスクの理解・セルフケア用品の使用

身体活動には、筋肉痛、筋肉・関節の損傷、転倒、既存症状の悪化などのリスクがあり、まれに重大なけがや死亡につながる可能性があることを理解します。無理な動作は行わず、動作の変更や休憩を申し出ることができます。

オイル等の用品は、参加者自身が使用するかどうかを選び、自分で塗布・使用します。私は、成分、既知のアレルギー、皮膚の状態などを踏まえて使用を判断し、使用に伴う皮膚刺激やアレルギー反応等のリスクを理解して引き受けます。不安がある場合は使用しないことを選べます。刺激や異常を感じた場合は、直ちに使用を中止します。

道具を使用する場合は、その使用に伴うリスクを理解し、案内された方法と自分の能力に合った範囲で使用します。

オンライン参加時は、安全に動ける場所と安定した道具を用意します。講師が画面越しに全ての動作や周囲の状況を確認できないことを理解します。

6. お子さまの同伴

子連れ可能なクラスでも、託児サービスやお子さま向けの指導は含まれません。同伴するお子さまの見守りは保護者が行い、安全な参加が難しい場合は休憩・中断します。

この同意書は成人参加者本人のためのものであり、お子さま自身の請求権を放棄するものではありません。

7. 確認・電子的な同意

私は18歳以上であり、この同意書を読み、質問する機会があり、内容を理解して自発的に同意します。申し込みフォームに入力した氏名と、同意欄へのチェックおよびフォーム送信を、この同意書への電子署名として用いることに同意します。

この同意書には、写真・動画の広告利用への同意は含まれません。該当する場合は別途確認します。

8. 言語

この同意書は日本語と英語で記載されています。両者の内容または解釈に相違がある場合は、適用法で認められる範囲で英語版を優先します。

9. 準拠法・裁判地

この同意書は、法の抵触に関する規則を除き、テキサス州法に準拠します。ただし、強制適用される法律を排除するものではありません。

適用法で認められる範囲で、この同意書または対象となる活動から生じる訴訟は、テキサス州Travis Countyに所在する管轄権を有する州裁判所、または同郡を管轄する連邦裁判所に提起するものとし、当事者は当該裁判所の対人管轄権に同意します。

10. 分離可能性

この同意書の一部が無効または執行不能と判断された場合でも、適用法で認められる範囲で、その他の条項は引き続き有効とします。

1. Covered Activities

This agreement applies to in-person and online lessons and programs provided by Vitalwit LLC. Activities include participant-performed pelvic-area self-exercises, stretching, body toning, face and neck self-care, and related general health and nutrition education. They do not include hands-on treatment or manual therapy by the instructor.

2. Not Medical Care

The lessons and health or nutrition information are not medical diagnosis, treatment, rehabilitation, or individualized medical or nutrition therapy. No particular improvement or result is guaranteed.

3. Health and Participation Decisions

I will decide whether and how to participate based on my health and physical abilities. If I am pregnant, postpartum, receiving treatment, recovering from surgery, injured, or living with a medical condition, I will consult an appropriate healthcare professional when needed to determine whether participation is suitable. Before participating, I will inform the instructor of restrictions or precautions relevant to safe instruction.

I will stop immediately if I experience pain, dizziness, difficulty breathing, or other concerning symptoms, and seek medical care as appropriate.

4. Understanding Risks and Using Self-Care Products

I understand that physical activity involves risks, including soreness, muscle or joint injuries, falls, and aggravation of existing conditions. Rarely, serious injury or death may occur. I may modify or decline movements and take breaks.

I will independently choose whether to use oils or other self-care products and will apply or use them myself. I will make that decision in light of the ingredients, known allergies, skin conditions, and other relevant circumstances. I understand and assume the risks of skin irritation, allergic reactions, and other adverse responses associated with their use. I may choose not to use a product if I have concerns. I will stop using it immediately if irritation or other concerning symptoms occur.

When using equipment, I understand the associated risks and will use it as instructed and within my abilities.

For online participation, I will provide a safe space and stable equipment. I understand that the instructor cannot observe every movement or condition in my surroundings through a screen.

6. Accompanying Children

Classes permitting children do not include childcare or instruction for children. I will supervise any child accompanying me and will pause or stop participating if safe supervision is not possible.

This agreement concerns the adult participant only and does not release a child’s own claims.

7. Acknowledgment and Electronic Consent

I am at least 18 years old. I have read this agreement, had an opportunity to ask questions, understand its terms, and voluntarily agree. I intend the name entered in my registration form, together with checking the agreement box and submitting the form, to serve as my electronic signature to this agreement.

This agreement does not grant permission to use photographs or videos for promotional purposes. Such permission will be requested separately when applicable.

8. Language

This agreement is provided in Japanese and English. If the versions differ in meaning or interpretation, the English version will control to the extent permitted by applicable law.

9. Governing Law and Forum

This agreement is governed by Texas law, excluding its conflict-of-laws rules, without displacing any mandatorily applicable law.

To the extent permitted by applicable law, any lawsuit arising from this agreement or the covered activities shall be brought exclusively in a state court of competent jurisdiction located in Travis County, Texas, or a federal court with jurisdiction over that county. The parties consent to the personal jurisdiction of those courts.

10. Severability

If any provision of this agreement is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.
